PRODUCT WARRANTY FOR POWER GENERATING UNITS

Product Warranty:

VEPI’s Power products are designed and built with quality performance and durability as the goal. Consequently, VEPI warrants the original end-user that, if properly installed, maintained, and operated under the product manual specifications, its Power Generating Systems are fabricated by VEPI with its power units (“Power Systems”) are free from defects in material and workmanship. Should a defect manifest during this warranty, VEPI will, at its sole discretion, repair, replace, or otherwise resolve the issue to the end user's satisfaction.

The actual shipping date of the unit from our facility.

 

d)    Duration: 

Three (3) years from "Coverage Start Date," or 8,760 hours (whichever comes first)

WARRANTY VOIDED OR NULL:

Failing to register new ownership or location.

Failing to maintain the online registry records currently.

Steel enclosures are warranted against rusting for the first year of ownership only. After shipping the generator(s), any shipping damage is the owner's responsibility and is not covered by this warranty. Nicks, scrapes, dents, or scratches need to the painted, and damage should be repaired promptly by the owner. 

 

All warranty expense allowances are subject to the conditions defined in Valencia Energy & Power, Inc.'s Warranty Policies, Procedures, and Flat Rate Manual.

GUIDELINES:

 

FOR THIS WARRANTY TO STAY IN FULL FORCE, THE FOLLOWING GUIDELINES ARE REQUIRED:

 

1. This warranty covers the original owner. It is only transferable between ownership of the original installation site. 

2. Upon completion of installation, repairs, or maintenance segments, the authorized technician shall perform tests to determine that the product is operating in conformity with the specifications and enter the online time/dated register within 48 hours of all work or maintenance completed to preserve the integrity of the warranty.

3. Claimant or client making a claim directly must provide satisfactory proof of all required maintenance recorded in the time/dated register for each work or maintenance completed. A hard copy shall be onsite with each unit to preserve the continuity of the warranty.

4. VEPI, in its sole discretion, may choose to repair, replace, or reach other resolutions to the satisfaction of the original owner.

5. Original Equipment Manufacturer (OEM), components in VEPI’s power units or systems may also be covered under the manufacturer’s warranty (the “OEM Warranties”) and may process claims for defects in material and/or quality on OEM components through the OEM distributor and dealer network.

6. Beyond this warranty coverage and or without the non-lapsed enrollment on the extended warranty program, VEPI shall neither guarantee nor assumes any liability under any other warranties.

 

 

THIS WARRANTY WILL NOT APPLY OR COVER THE FOLLOWING:

 

Damage Caused by Third Parties Interposition:

 

1. Improper installation, maintenance, alterations, or repairs (done by third Parties) not authorize, verify in writing by VEPI to work on our power systems.

2. Damages related to shipping, relocation, or the use of an unsuitable method of transportation or improper handling or caused by accident.

3. Damage or failure caused by misusing the unit with modifications, alterations, or power systems that do not have original replacement parts or operating at speeds and loads contrary to product specifications and extended disuse.

4. Damage or failure caused by mismanagement, abuse, and other negligent treatment and handling while in transport or custody of any other third-party owner.

5. Any modification, alteration, or connection to any other power generating system, unsuitable, or incompatible power equipment(s).

6. Damages related to the misuse by the owner, or end-user, or another third party, or adapting parts or components including transfer switches or software updates that VEPI has not recommended.

7. This power generating unit's warranty is voided and null if generators are used for an application that has not been designed or categorize by VEPI, including but not limited to a stationary unit used for rental, trailer mounted, marine, or mobile applications, etc. 

8. Exposure to harmful or natural human-made elements, including harsh environmental conditions, including but not limited to sand, extreme weather, salt, or exposure to rodents or any other animal infestation.

9. Damages associated with an Act of God or causes that are reasonably outside the control of the VEPI, including but not limited to earthquakes, windstorms, lightning, wildfire, wars, riots, governmental actions including seizures or sealing of power system, etc.

10. The cost associated with acquiring other alternative power supplies during warranty repair, part replacement, or maintenance.

11. System installation in locations or work completed by technicians that do not meet the requirements of VEPI.

12. Costs of routine maintenance (i.e., tune-ups and associated parts), adjustments, loose/leaking clamps, installation, and start-up.

13. Steel enclosures that are rusting due to improper installation, location in a harsh or salt weather environment, or scratched or damage where the integrity or paint applied are compromised.

14. Failures inflicted by any contaminated oils, coolants, or lack of proper fluid amounts.

15. Failures due (but limited to normal wear and tear), accident, misuse, abuse, negligence, or improper installation. As with all mechanical 
devices, the VEPI drive motors need periodic part(s) service and replacement to perform as designed. This warranty will not cover repair when 
normal use has exhausted the life of a part(s) or motor.

16. Any incidental, consequential, or indirect damages caused by defects in materials or craftsmanship or any delay in repairing or replacing the 
defective part(s).

17. Telephone, cellular phone, facsimile, internet access, or other communication expenses or devices.

18. Living or travel expenses of person(s) performing service, except as specifically included within the terms of a specific unit warranty period.

19. Expenses and fees related to "customer instruction" or troubleshooting where no manufacturing defect is found.

20. Rental equipment used while warranty repairs are being performed and/or overnight freight costs for replacement part(s).

21. Costs incurred for equipment used for removal and/or reinstallation of the generator (i.e., cranes, hoists, lifts, etc.)

22. Planes, ferries, railroads, buses, helicopters, snowmobiles, snow-cats, off-road vehicles, or any other transport mode were deemed abnormal.

23. Any overtime or extra labor payment, holiday labor bonus, emergency, or hazard labor pay.

24. Starting batteries, light bulbs, grease, and fluids. 


 

THIS WARRANTY IS IN PLACE OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED. THIS IS AN EXCLUSIVE WRITTEN WARRANTY.  VEPI MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND NO ONE IS AUTHORIZED TO MAKE ANY OTHER WARRANTIES ON BEHALF OF VEPI. ANY IMPLIED OR STATUTORY WARRANTY, INCLUDING ANY WARRANTY OF MERCHANTABILITY FOR A PARTICULAR PURPOSE, IS EXPRESSLY LIMITED TO THE DURATION OF THIS WARRANTY. VEPI SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO WHERE SUCH DAMAGES ARE A DIRECT RESULT OF VEPI’S NEGLIGENCE. 

 

FOR USA CUSTOMERS:

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL AND/OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
